Out-of-court conciliation in administrative law
In administrative litigation, out-of-court conciliation is, as a rule, held before Administrative Judicial Procurators. Title V of Law 2220 of 2022 adds three principles: protection of public funds and the general interest, protection of certain and indisputable rights, and reinforced protection of legality. Without that stage, when it is required, the court dismisses the claim.
When it is required
Articles 92 and 93 of Law 2220 make it a condition of proceeding in conciliable matters: typically nullity and restoration with a pecuniary claim, direct reparation, and public-contract disputes. It does not lie, among other cases, where the statute forbids it, where the general interest or non-disposable rights are directly affected, or in objective simple nullity. The operator is the Administrative Judicial Procurator, not a private center. The administrative-court judge must approve a settlement, looking at public funds and legality.
