Problem
The tutela in Colombia
The tutela is the preferred, immediate remedy to protect fundamental rights when no other adequate path exists, or when irreparable harm is at stake. It is Article 86 of the Constitution, implemented by Decree 2591 of 1991.
When it usually lies
When a fundamental right is being denied by an authority — or, in some cases, a private party — and waiting for an ordinary lawsuit would make protection useless.
If a judgment is already in hand and is ignored
A contempt incident is the way to enforce the order. You must prove notice of the judgment and the failure to comply.
Questions
- Does a tutela replace a damages suit against the State?
- No. Ordinary money claims belong in the administrative courts, with pre-suit conciliation when the statute requires it.
